1.Privacy Policy

Jamsphere LLC ('‘Jamsphere," "we," "us" or "our") is committed to respecting your privacy. This privacy policy and agreement (the "Privacy Policy") covers how we collect, use, and treat Personal Information that you may provide either (i) through this website and related mobile applications (" Website" or "Site"), (ii) by contacting us directly by phone, email, or another communications channel, or (iii) while visiting one of our physical locations (collectively, the "Services").

Our Privacy Policy applies to any visitor to the Website (collectively, "you"), including (i) casual visitors to our Site who do not sign up for an account on the Website ("Site Visitors"), and (ii) users who have registered with Jamsphere through the Website (collectively, "Registered Users") as well any other providers of Personal Information who use the Services.

Your Consent

Please read this Privacy Policy carefully because it creates legal obligations on you and on Jamsphere. You show your consent to this Privacy Policy by using our Website or visiting one of our physical locations (as applicable). We may also request your express consent when you become a Registered User or complete a purchase with us. In either event, you are acknowledging that you have read and understood this Privacy Policy, and agree to be legally bound by it. If you do not agree with the terms of this Privacy Policy, please refrain from using our Services.

We collect a few categories of information as described in this Section (Types of Information We Collect). We may collect this information through different sources as described in the next Section (How We Collect Personal information) below.

We use the term "Personal Information" to mean any information that identifies you as an individual, and any other information we associate with it. We may receive Personal Information from you directly, such as:

  • Your name, email address, and password;

  • Other contact information including a physical address and phone number;

  • Your payment and billing information;

  • Other content you affirmatively provide to us through the Sites;

  • Any information or feedback you provide in communications with us through our Website or via social media, email or our customer call center;

  • Your orders and transactions with us.

If you provide us with any Personal Information relating to another individual, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

How We Use The Information We Collect

We use the information we collect or process, including Personal Information, Online Activity Information and Anonymous Information, as permitted under applicable law and consistent with the terms of this Privacy Policy. More specifically, we use the information we collect for the following purposes:

  • To provide you with the Services you request (on the Website, by phone, in our stores or otherwise), including use of our Website, to complete purchases, order fulfillment, returns and other needs associated with a transaction, to create and manage Registered User accounts, and to communicate with you regarding our Services;

  • To allow you to post User-Generated Content, submit photographs for marketing or other purposes and to process your requests using such photographs, use AR features of our mobile applications, and participate in surveys and questionnaires;

  • To respond to your inquiries;

  • To customize and enhance your use of our Website and Services, such as by personalizing your experience with us;

  • To provide communications that might interest you, including marketing messages and to inform you of products and services that we think would be appealing to you, whether the products or services are provided by us or by others, and whether the products or services are available via our Site or via a third party;

  • To verify your identity and to securely process your purchases or other requests for Services;

  • To perform analytics, quality control, market research, and to determine the effectiveness of our Site, promotional campaigns, to improve our current products, Services, and Site, and develop new products and services;

  • To perform internal administration, auditing, operation, and troubleshooting for our Site and Services;

  • To share the information with third parties strictly as permitted in Section 8 (How We May Disclose Your Information) below;

In addition to the uses specifically identified above, there may be instances where you request information and Services from us that are not described in this Privacy Policy. In our discretion, we can use information that you submit in order to provide such information and Services.

Treatment of Combined Information

To enable us to better understand the characteristics of our customers and/or to provide Services tailored to your needs, we may link your Personal Information with Online Activity Information associated with you or other Anonymous Information. If Online Activity Information or other Anonymous Information is ever associated or combined with your Personal Information (such as a name or email address), we will treat it as your Personal Information subject to the terms of this Privacy Policy.

Other Essential or Internal Uses of Information

We may also use information we collect as we believe to be necessary or appropriate for certain essential purposes, including:

  • To comply with applicable law and legal process;

  • To respond to requests from public and government authorities, including public and government authorities;

  • To detect, prevent, or investigate potential security incidents or fraud;

  • To facilitate the functionality of our mobile applications and websites;

  • To provide important product safety information and notice of product recalls;

  • To enforce our terms and conditions;

  • To protect our operations or those of our affiliates;

  • To protect our rights, privacy, safety or property, security and/or that of our affiliates, you or others; and

  • To allow us to pursue available remedies or limit the damages that we may sustain.

2. Terms of Sale

If the merchandise ordered by you is not available for pick-up or delivery by the promised delivery date, Jamsphere must offer you the choice of: (1) canceling your order with a prompt, full refund of any payments you have made, or (2) accepting merchandise at a specific later date.

Cancellation Policy:

  • You're in control! Cancel your order for a full refund until delivery or pickup day.

  • Standard shipping items can be canceled until they ship, even those shipped directly from our factories.

Standard Return Policy & Limited Warranty:

  • We value your satisfaction. Once you receive your furniture, returns are limited to specific cases.

  • Enjoy a 1-year limited warranty on regular-priced furniture against factory defects from the original receipt date as long as the item is still within our delivery area.

  • Let us know about any factory defects, and we'll arrange in-home service within the 1-year warranty period. Please note, this excludes items shipped directly from the manufacturer.

  • In-home service is available for a fee outside of the 1-year warranty period - not including items shipped directly from the manufacturer.

  • Jamsphere specifically disclaims any liability for damages or injuries that result from failure to follow assembly instructions.

  • Our products are not guaranteed against normal wear and tear, abuse, or neglect, or from damage resulting from improper use, care, or storage.

  • All implied warranties, including warranties of merchantability and fitness for a particular purpose, are expressly limited to the 1-year period of the limited warranty.

  • Your state may provide additional legal rights beyond this limited warranty.

  • Merchandise purchased from Jamsphere Outlet that is not brand-new or factory-fresh is sold "as-is," and is excluded from this limited warranty and service policy. There is no exchange, warranty (express or implied), refund, return or service for such items. You assume all risks as to the quality and performance of such items. You also assume the entire cost of all servicing and repair should such item prove defective following your purchase.

3. Refund Policy

General Refund Eligibility

  • Refunds are available only for items that are defective, damaged during shipping, or not as described on our website.

  • We do not offer refunds for change of mind, incorrect selection of size/color/finish, or buyer’s remorse on correctly supplied, undamaged furniture.

  • All custom-made, made-to-order, or specially ordered items are non-refundable and non-exchangeable (including fabric, leather, wood finish, size, or configuration changes).

Time Frame for Refund Requests

  • You must notify us of any issue within 7 calendar days of delivery/receipt of the item.

  • For damage or defects discovered after assembly, notification must still be made within 7 days of delivery.

  • After 7 days, the item falls under our separate Warranty Policy (see section 8).

Condition of Returned Items

  • Items must be unused, unassembled (where possible), and in original packaging with all parts, hardware, manuals, and accessories.

  • Mattresses must have the law tag attached and be in unused condition with protective plastic intact.

  • Any item that has been assembled, used, or shows signs of wear will not qualify for a refund (but may qualify for warranty repair/replacement).

Refund Process

  1. Contact our Customer Service team within 7 days at [email/phone] with photos clearly showing the issue.

  2. If approved, we will provide a Return Authorization (RA) number and return instructions.

  3. You are responsible for return shipping costs unless the item arrived damaged or defective.

  4. Once we receive and inspect the item, we will issue a refund to your original payment method within 7–14 business days.

  5. Original shipping/delivery fees and any assembly/white-glove service fees are non-refundable.

Damaged or Defective Items

  • If your furniture arrives damaged, refuse delivery if possible and note the damage on the delivery receipt, or accept and contact us immediately with photos.

  • We will arrange repair, replacement, or refund (at our discretion) at no cost to you.

Cancellation of Orders

  • Orders can be cancelled for a full refund only if they have not yet entered the production or shipping process.

  • Once an item is in production (especially custom orders) or has shipped, cancellation is no longer possible.

Exchanges

We do not offer direct exchanges. If you need a different item, you must return the original (if eligible) and place a new order.

Manufacturer’s Warranty (After 7 Days)

Issues reported after 7 days are handled under the manufacturer’s warranty (typically 1–10 years depending on the product). Warranty covers manufacturing defects only and usually provides repair or replacement parts—not a refund.

Exclusions

No refunds or returns on:

  • Clearance, “As-Is,” floor models, or discontinued items

  • Custom/upholstered furniture

  • Items marked “Final Sale”

  • Gift cards

How Refunds Work:

  • We'll credit the original credit card for refunds unless stated otherwise.

  • Cash, check, traveler's check, or money order payments will be refunded via check within 10 business days.

  • Refund checks will be mailed to the purchaser or sold-to party on the sales receipt.

  • This limited warranty doesn't void your rights under any state law in case of late or nonconforming delivery.

4. Delivery and Pickup Options:

  • Jamsphere provides full-service delivery, unpacking, assembly, and trash removal.

  • If you have not yet scheduled your delivery or pickup appointment, we'll send you a link when your items are ready for scheduling (for pickups of in-stock items, it's typically within 10 days following your order).

  • If your furniture doesn't fit through your threshold entrance, the delivery team cannot hoist it.

  • During the winter season, the delivery team cannot complete deliveries unless all of your entrances, driveways, walkways, sidewalks, and stairs/steps are free of snow and ice, as well as being salted or sanded.

  • For pickups:

    • Bring a safe vehicle, ID, sales order, vehicle packing material, padding, and rope.

    • Our warehouse personnel will assist with loading, but securing the merchandise is your responsibility.

    • Inspect your furniture before leaving, as we aren't responsible for damage once loaded.

    • Some merchandise may require assembly as it comes in factory packaging.

Shipping Details:

  • FedEx shipments include tracking numbers to keep you informed about your merchandise in transit.

  • Replacement parts are typically shipped via USPS.

Proof Protection:

  • Guard against all stains and most accidental and unexpected damages.

  • Enjoy 5 years of coverage

Protecting Your Privacy:

  • We respect your privacy and will only use your contact information to communicate with you about Jamsphere.

  • By providing your contact information to Jamsphere, you agree to our Terms of Use and Privacy Policy, and permit us to use an automatic telephone dialing system and prerecorded voice or text messaging to contact you regarding delivery, for quality assurance purposes, and for any other purpose.

  • You can opt out of marketing texts and communications at any time

Resolution of Disputes:

  • Any claims or disagreements between you and Jamsphere arising out of, or relating to, this agreement or any products or services purchased from Jamsphere will be resolved through arbitration

  • You and Jamsphere further agree to bring any claim on an individual basis only.
